Con\u00adnecti\u00adcut ACLU Legal Direc\u00adtor Dan Bar\u00adrett said that it also applies to gov\u00adern\u00admen\u00adtal deci\u00adsions and account\u00adabil\u00adi\u00adty. He says that due process includes vot\u00ading and trans\u00adpar\u00adent gov\u00adern\u00adment.&nbsp;<\/p>\n\n\n\n<p>\u201cYou could say [due] process is like the foun\u00adda\u00adtion of democ\u00adra\u00adcy, for the basic rea\u00adson that we tend to think that when the gov\u00adern\u00adment does some\u00adthing, it ought to have a rea\u00adson for it, and about to have some basis for doing it,\u201d he said.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>The Fifth Amend\u00adment and the 14th Amend\u00adment both estab\u00adlish due process rights, but for dif\u00adfer\u00adent rea\u00adsons. The Fifth Amend\u00adment estab\u00adlished the right against tes\u00adti\u00adfy\u00ading against one\u00adself or being tried for the same crime twice and also estab\u00adlish\u00ades due process rights in regard to the fed\u00ader\u00adal gov\u00adern\u00adment. The 14th Amend\u00adment, which estab\u00adlished the equal pro\u00adtec\u00adtion clause, applies due process&nbsp;to the states. &nbsp;&nbsp;<\/p>\n\n\n\n<p>Due process does not just apply to U.S. cit\u00adi\u00adzens \u2014 it applies to every\u00adone in the coun\u00adtry, even undoc\u00adu\u00adment\u00aded immi\u00adgrants, Bar\u00adrett said. &nbsp;<\/p>\n\n\n\n<p>\u201cHere in the Unit\u00aded States, there\u2019s a cou\u00adple of pro\u00advi\u00adsions of the Con\u00adsti\u00adtu\u00adtion that speak to Amer\u00adi\u00adcans specif\u00adi\u00adcal\u00adly, but the rest of it speaks in gen\u00ader\u00adal\u00adi\u00adties,\u201d Bar\u00adrett said. \u201cAnd so if you are phys\u00adi\u00adcal\u00adly present, you are sub\u00adject to Amer\u00adi\u00adcan law\u2026 you have the pro\u00adtec\u00adtions, for exam\u00adple, of due process, which means that you get a notice and a mean\u00ading\u00adful oppor\u00adtu\u00adni\u00adty to be heard on the ques\u00adtion of whether or not you are in the coun\u00adtry law\u00adful\u00adly or should be removed.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>Trump has repeat\u00aded\u00adly said that undoc\u00adu\u00adment\u00aded immi\u00adgrants pose \u201csig\u00adnif\u00adi\u00adcant threats\u201d to Amer\u00adi\u00adcans to jus\u00adti\u00adfy his crack\u00addown on immi\u00adgra\u00adtion. Bar\u00adrett said that instead of going through the immi\u00adgra\u00adtion courts, the Trump admin\u00adis\u00adtra\u00adtion is just decid\u00ading to \u201ceject\u201d peo\u00adple with\u00adout due process.&nbsp;<\/p>\n\n\n\n<p>&nbsp;\u201c[The admin\u00adis\u00adtra\u00adtion] des\u00adig\u00adnates peo\u00adple as ene\u00admy aliens, regard\u00adless of what some judges said,\u201d Bar\u00adrett said. \u201cIt loads peo\u00adple onto planes and flies [them] into coun\u00adtries they\u2019ve nev\u00ader been to and dumps them there.\u201d&nbsp;<\/p>\n\n\n\n<p>An exam\u00adple of due process is a writ of habeas cor\u00adpus: an order to an offi\u00adcial who has some\u00adone in cus\u00adtody \u2014 like a police offi\u00adcer or immi\u00adgra\u00adtion offi\u00adcer \u2014 that says they must bring the pris\u00adon\u00ader to court to explain the detain\u00adment. The court will deter\u00admine if detain\u00adment is law\u00adful or not. If they find it unlaw\u00adful, the court can demand their release. Arti\u00adcle 1, Sec\u00adtion 9 men\u00adtions two excep\u00adtions to habeas cor\u00adpus: rebel\u00adlion or pub\u00adlic safe\u00adty. Dur\u00ading the Civ\u00adil War, Pres\u00adi\u00addent Abra\u00adham Lin\u00adcoln used the pub\u00adlic safe\u00adty excep\u00adtion to sus\u00adpend habeas cor\u00adpus in an attempt to quash anti-Union rebel\u00adlion.
