Executive Order 14160: “Protecting the Meaning and Value of American Citizenship”

This exec­u­tive order seeks to change who gets to be an Amer­i­can by deny­ing cit­i­zen­ship to chil­dren born in the U.S. to par­ents with­out per­ma­nent legal sta­tus or who are non‑U.S. cit­i­zens. This order would essen­tial­ly exempt those chil­dren of the pro­vi­sions of the 14th Amend­ment, which states “All per­sons born or nat­u­ral­ized in the Unit­ed States, and sub­ject to the juris­dic­tion there­of, are cit­i­zens of the Unit­ed States and of the State where­in they reside.” It is unclear whether this order would result in an influx of state­less chil­dren and if sys­tems would be imple­ment­ed to sup­port them. On Dec. 5, 2025, the Supreme Court declared that it would hear argu­ments on the legal­i­ty of the exec­u­tive order in spring 2026, with a rul­ing expect­ed by ear­ly sum­mer.
