
This executive order seeks to change who gets to be an American by denying citizenship to children born in the U.S. to parents without permanent legal status or who are non‑U.S. citizens. This order would essentially exempt those children of the provisions of the 14th Amendment, which states “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” It is unclear whether this order would result in an influx of stateless children and if systems would be implemented to support them. On Dec. 5, 2025, the Supreme Court declared that it would hear arguments on the legality of the executive order in spring 2026, with a ruling expected by early summer.
